Now, as most of us who are drivers know, when we're involved in a motor vehicle accident where there's at least $1500 property damage or bodily injury occurring, we must W/I 48-72 hrs notify our state's motor vehicle Department of the particulars and whether we have motor vehicle liability coverage at time of the MVA.

Most states have procedures to allow W/I reasonable time a driver to show he did have insurance coverage at time of a reported MVA, and to, absent auto liability insurance coverage, show cause why the DMV should not suspend driving privileges. It would appear that subsequent to Mr. Kirk's MVA he hasn't been able to timely provide proof of his possessing auto liability insurance at the time of his accident. As a proximate result of Mr. Kirk's not providing information of his possessing auto insurance liability coverage the California DMV suspended his driving privileges.

Driving privileges are ordinarily suspended till such time a driver can show to DMV by way of an SR-22 filing proof of auto liability insurance converge. If, as Mr. Kirk asserts, his being under "4 yr" suspension then this may be the result of a greater violation of law involving the use of a motor vehicle- driving under the influence on intoxicants, with possible prior violations, possessing and/or sale of illegal substances, and so on.

I would suggest Mr. Kirk's driving privileges are suspended not as a result of some other driver's actions, but as a result of his poor management of his driving responsibilities, .
