It appears your sensible and informative comment went unread or uncomprehended. One of the pitfalls of FELA is that many people just scream "lawsuit". We should all be reminded that if the railroad, as employer, would offer a fair settlement for lost wages, medical expenses, pain and suffering then there would be no need for a lawsuit. In fact, under the law the railroad owes the injured or dead nothing unless there is a suit. Some railroads offer a decent settlement in order to forestall a lawsuit. I think that's good business but its rare.
