Arrogant or not, or using silly metaphors thinking you are simplifying the answer to this situation gets us nowhere UDEUH. Come up with a compromise or people will still break the law and none of your "property rights" arrogance will get this situation solved. Technically you are very right but ever since railroads weree built in this country people have enjoyed the freedom to use the ROW as an observation platform for taking photographs and it's only in recent history that we're seeing the railroads start to enforce.
