Sadly, under Staggers, this is perfectly legal. Shortline Sammie can correct me, but CORP can charge up to 100 percent of their costs to the shippers. Case in point, the NWP surcharge of 1983 which was $1200 per car. I would persume, this $3,000 per car is within this same range. Of course, like the NWP, it will be the nail in coffin and shippers will now truck everything and the railroad can show little or no movement on the rates and can abandon the line. Is it right, yes and no. Utilize the line or lose it. But if CORP is not delivering cars, switching the plants, running trains only when it has a 100 cars together or not perform MOW to keep the line within FRA standards, then no. CORP can say "we will run once a week" and most shippers actually will adjust their non-expedited shipment to comform to that.
