STB has NEVER ruled to limit number or length of trains. Despite the fact the NCRA is a public body and the taxpayers own the ROW, the operator can and will develop traffic as HE SEES FIT! NCRA was formed by the legislature with a mandate to preserve the NWP and run FREIGHT ON IT. So you and NOVATO would have to change the legislation and I don't think with the emphasis on the environment that ANYONE would carry that legislation. So why not come up with a better argument and no go over the same ground. Northeast corridor goes through some of the priciest backyards in the country. Its publicly owned and CSX railroad runs dozens of freight trains a night 100 cars long so 110 passenger trains can run during the day. Nothing can stop them and NO EIR was required because the railroad like the NWP was pre-existing. Check the facts!
