One of the few times Judy ARNOLD Aka "Misty ESQ" and I agree, especially the part that voting for SMART will control freight. I supposed thats is to appease those folks in Marin and Novato specifically so they don't lose their vote. More double track or more sidings will allow more flexibility with freights during the daytime and I think SMART is on top of this and will facilitate better dispatching allowing for the daytime moves. Most commute trains will run south in the morning and north in the late afternoon. Thus the slower freights can follow the passenger trains south and vice a versa in the evening. This is not rocket science. Judy, you should go and look at Caltrains on the Peninsula. They run 96 trains a day and are able to dispatch Union Pacific Freight trains of 85 cars going to the Port of S.F. during the middle part of the day with commute trains running at half hour intervals. SMART will not be close to that frequency and freights rarely run later then midnight between San Jose and San Francisco. Finally, SMART DEIR and final EIR are required because SMART is a public body using taxpaper money. If it were a "PRIVATE" operation, none would be required. Similarly if NWP was not owned by NCRA, it also would be exempt from an EIR. The classic case is the UP Trestle Fire in Sacramento last year. UP rebuilt a half mile of trestle in 15 days without a single permit or an EIR. They piledrived 24 hours a day and was not restricted in anyway because everything was done on their property and within the ROW. Thats also why when NCRA got $3 million from FEMA, they (FEMA) gave them a Categorical Exemption for use of the funds because all work was with the existing ROW.
