Can a city sue a county based entity as NCRA's reps are appointed by county supervisors. Are not railroads, within one state only subject to the state's approval in terms of planning and the feds for safety ? This is a pre-existing use and certainly NCRA's intentions were known for many years. And then there's the gravel pit issue on the Eel River. Eco-nuts claim it's part of the state wild rivers area and can't be mined. I believe mining rights superceded scenery laws.
