Pro rail interests have appealed Judge Ritchie's
ruling. We will see what transpires. For the record,
NCRA never took the legal position in the lawsuit that there
weren't significant impacts associated with the track
repair, only that Novato's opportunity
to notify the NCRA that it opposed the "negative declaration"
had passed. The NCRA has gone to this well several
times with the judge and lost. The appeals court
hasn't even said they will "hear" the case, only that
they will consider it. Are they taking this step because
it involves two separate public agencies? Or are they taking
this step because they think Judge Ritchie has made an
error?
We'll know more for sure in the summer. But if were a
betting man, I would bet the appeals court will uphold
Judge Ritchie. He's pretty thorough.
BTW, it means little that the AG's office has entered the
case. Jerry Brown is a Doug Bosco pal.
