Then you agree that Neary's appeal that federal regulations override the state
CEQA process in this case has no hope. And I agree. It's because of the money.
Besides, the judge isn't saying they can't operate a railroad -- which is clearly
federal perogative -- it is that they can't continue the "project" funded with
state money, until they meet state environmental requirements.

P.S. My guess is that after the NCRA loses at the state appellate level they're
going into federal court, looking for the federal court to intervene in a state
matter. (Kind of akin to Bush v. Gore, eh?)
