Whoa, there. Not so fast. I’m not on board with anything. I have not read either NCRA's appeal or the amicus briefs of the Attorney General and the Department of Fish and Game. I have no basis to either applaud or deride the merits of NCRA's arguments because I have no independent knowledge of those arguments. In the abstract, there would be a technical distinction between stopping the project and stopping the money. The Marin court does not have the authority to stop the project (federal law does preempt State law in that instance), but, if the facts warrant, it would have authority to deny NCRA the use of State money to continue the project. You direct me to the text of the briefs and then, if there is anything worth discussing, we can speak – or write – more or less knowledgeably.
