The ICTA (Interstate Commerce Commission Termination Act) gives the Surface Transportation Board sole authority in the regulation of common carrier railroads. I believe this attempt by California to regulate goods moving by rail in interstate commerce is preempted by Feeral statute. The railroads are correct in saying the proposed hazmat tax is illegal.
