Apparently the California legislature discussed the matter with their lawyers before passing the law. It is not a tax on the railroads. It is a tax on the shipper that is to be collected by the railroads and paid to the state.
It will be interesting to see what the courts think of this interpretation. As others have already pointed out, fees like this are already charged truckers by certain states for allowing entry of hazardous loads.
