I would point out that deadly passenger train wrecks caused by reckless operators are thankfully uncommon and holding an engineer to account is a rare occurrence. We don't have to worry about the jails getting full. Times have changed, today if you run a red light and T-bone a car killing the other driver, you are likely to be arrested, if you drive a school bus 20 mph over the speed limit and the bus tips over killing students, you will been arrested.
