Actually, The OSHAct is the driving force. While railroads are specifically exempted from regulation by OSHA, railroads must meet recognized safety standard often promulgated by OSHA. OSHA, in recent years, is increasing the scope and jurisdiction over railroads. As a matter of record, Noise Induced Hearing Loss (NIHL)causes a strain on the financial level to railroads, especially in light of numerous cases in the 80's. Shockingly, there have been few class actions against railroads for NIHL, unlike shipyards and asbestos litigation.
Most railroads today are proactive and have their own Industrial Hygiene groups to help further worker protections.
