CSX is appealing this decision.
The sad thing is the film crew was warned and denied on paper not to work on CSX property.
I read that the engineer on the train did not plug the emergency brake for fear of derailing into the bridge, river and into the people. His decision, as well as the fact that the other trains that passed earlier in the day did not call the police or report trespassers, was the 'reason' why the jury sided with the plaintiff.
So effectively, because CSX didnt send police to personally evict/escort everyone away after already denying them access to the site, is the reason why the railroad is 'to blame' for this tragic death. (even though the director was the one truly at fault in the original case)
If this penalty stands, look for all of the Class 1's to implement and enforce an even stricter zero-tolerance trespassing policy for everyone... including railfans.
I wouldn't blame the railroads at that point as they could trust no one, not even their friends in the railfan community. Just my 2 cents.
