Can you provide data to back up your claim that "regular" police and railroad cops avoid gangs, "illegal invaders" and homeless?
I don't know where you get your news, but I've read about greatly stepped up deportation of human beings deemed to be in the United States unlawfully.
With respect to gangs, I'm sure many law-enforcement personnel involved in anti-gang initiatives would be insulted by your statement that they avoid gangs like the plague.
If any homeless people hop a freight train (making them hobos), law enforcement would deal with them swiftly.
Bringing in the ACLU into this discussion is really ridiculous. An internet search of ACLU and railroads did not bring up any evidence that ACLU "is forcing the rails to accept the gangs and homeless under the threat of lawsuit?" On the contrary, the ACLU has worked to protect for people to take photographs when there have been restrictions against photography.
I was in Denver for the past few days to attend a professional conference, but I also did some railfanning. Yes, I saw many homeless people, a couple of whom were trespassing on railroad property. I never occurred to me to wonder if cops were avoiding them, because I wasn't with them 24/7 to know if that was true or not.
I have been railfanning for 45 years in cities and rural areas in the Northeast, Midwest, Rocky Mountain region and Pacific Coast. In all of that time and all of those places I've only been hassled 4 or 5 of times by railroad cops, the most recent of which was 14 years ago. No problems since then. I'm able to watch all the trains I want and get the photos I seek without getting into trouble with the law. If you are competent, you should be able to do the same.
