Do they have on-board forward facing incident cameras on SMART trains? Do they have downward facing camera's on the rail gates? If they have either of these, they more than enough evidence to cite this person for failure to yield, running a rail crossing, and they have a clear basis and the evidence for suing this moron for delay and damages......
SMART should prosecute him and file a claim for estimated delay and response costs.........
Too often, these people are not cited by police agencies, as they are now just another poor "victim" of that Evil Thomas......
Of course, they did blow the horn (we're in the part of these posts where the idiots who never bothered to read the original story start posting horse crap).... but he was illegally wearing earbuds while operating a vehicle on a public road, which still made him unable to hear it..... But, that does add another charge to cite him on and fine him for.
