Since it is likely there is no accurate records of what actual materials were used to make the wood black it would seem federal and state environmental agencies would classify all these millions of ties spread across numerous states as hazardous materials. Use of any of the ties would not be allowed, ties already installed would need to be removed. I am sure Boatwright will feign bankruptcy leaving the NS and taxpayers to pay the costs. Probably no one will really go to jail for such fraud.
