I think they ,Atty & engineer, are going after the whistle blower ave.of approach. Thats the reason the judge kept the case and let it proceed.

Otherwise, it would go under the rules of agreement between BNSF and the BLE&T. He has been fired so this also would be covered being re instated under the WB laws, not a E&F Agreement.

Attorneys try to ignore laws that are right in front of them, hoping they can BS the courts with a bunch of crap like union agreements.

Again, I am surprised the carmen stood up but the carrier knew that firing HIM that would trigger the WB act.
