Amtrak always liable?

I found this article very interesting. It seems as if the freight railroads have somehow negotiated themselves out of responsibility. As a tax-payer, who is very willing to pay his share to public transportation, this frustrates me. It seems as if Amtrak is over a barrel when it comes to negotiating with the host railroads, almost having to accept any demand in order to work out a deal.
