eBART is a completely separate system from BART. eBART uses it's own tracks and uses DMU's instead of the computer controlled trains that standard BART uses. BART operators are not engineers and are not subject to the FRA regulations. eBART, on the other hand, specifically hired pre-certified engineers and conductors for their system. The eBART system is subject to FRA regulations, since it is a "rail" system and not a "transit" system.
