Balderdash - Kopp et al wanted to specify parameters precisely to prevent bait and switch, aka the inevitable dumbdown so popular with the Tehachapi-Palmdale detour crowd.
The dumbdown has indeed been challenged many times in the courts; the problem sits with the lazy-ass "I'm too dumb to understand anything about Prop 1a or railroading" worthless Party puppet judges. A typical highschool student could look at Prop 1a's provisos, look at the according map, add up some mileage figures and right away realize the only 2:40 could be met is with in your face requirements: (1) you have spend many fortunes on civil works worthy of a Pharaoh(base tunnels)and run your trains at 200mph through towns.
The whole idea was hopelessly and internally flawed from the outset. As soon as it was determined those putatively in power did not have the stones to take on the Tejon Ranch Co. it should have been forthwith chucked.
On the other hand the Caltrain electrication is underway thanks to CAHSR providing the funding and the gravitas to fend off MTC. Now BART is now going to have to undergo the humiliation of its beercan catttlecars compared to state of the art standard gauge OC railcars. Tech that has never been seen in latterday California. BART will look so deservedly retro ghetto.
