Presumably WA could joint the states group and add on to the contract, then negotiate with the others an advanced point in line for delivery. That seems like their best bet. Not sure if Amtrak could or should join that contract, due to their different procurement processes.
Is Siemens the only company that's currently able to deliver FRA-compliant (using crash energy management) passenger equipment meeting Buy American requirements? Does Bombardier or Alsthom still have a plant in NY state and a compliant design that's quickly deliverable? The other one-off assembly plants all seem to be gone, or at least very quiet.
If WA could come up with the money, I'm sure Amtrak could refurb some of the ancient junk for them that's sitting around at Beech Grove. It still wouldn't meet current FRA standards, though, and wouldn't work as well (require slower schedules).
