Talgo 6 did have a waiver, but doesn't mean that NTSB should be sued. NTSB can't force WSDOT to upgrade, they are doing it on their own volition. Also, wheel stems on Talgo 6 is unique to Talgo 6s. The fact it broke off and killed a passenger is not good for their argument.
