Unless the derailment meets the FRA threshold for a "reportable incident"...I believe currently $11,000, the FRA doesn't get involved. There are NO standards for "excepted track" other than gauge requirements for curves and certain hazmat requirements for bridges over public waterways/highways which I'm not required to deal with on an everyday basis and can't address. Because the track looks bad unless you are trained to identify what you observe as defects it's probably perfectly legal under FRA unless there is wide gauge.
