The City of Richmond has no authority over what moves on UP or BNSF through the city. However, it does arguably have authority over how land is used and businesses operate within the city, so operation of a coal terminal within the city may be within their purview. Notice the weasel-words; if whoever was going to run the terminal wants to go to court, especially federal court, the current collection of appellate and Supreme court justices might just come to a different conclusion.

But then Oakland did it, right? Why not Richmond?
