There are enough "hoops" to make folks think about how they might have to justify whatever rule compliance they might choose to feel they need to "waive", and FRA a lot of discretion in what the consequence might be...?
While that seems a little vague, I suspect that if the choo-choo were to actually have an accident, this language also gives the FRA a lot of discretion (to cover it's own butt after the fact is such a case), to say we didn't say "that"(whatever does go wrong from some rule that was "waived"...) was okay, and how could you possibly justify that...
But, this kind of we'll just do it and issue this kind of directive, and sort of re-interpret statute, or ignore precedent, seemingly at FRA's discretion, if the carrier can come up with some reasoning the FRA will buy off on to justify it, is also loose enough that it has some potential for a carrier wet dream, with a carrier friendly FRA....
This will be interesting. Another amusing side show in this current circus....
We shall just have to wait and see what happens on the next episode of The Apprentice....
