Consider this: Novato gave up their suit and the SMART bill passed. Whether this reopening of the NWP is brilliant or idiotic, it appears the state will throw the $$$$$$ at it either way. (Sorry, but I don't think that abandoning the NWP would result in a reduction in your taxes.) Make the best of it--go railfan the thing. If it craps out later, be glad you got some pictures, then go find something else to chase. If you're morally outraged by this "travesty," register your opinion by NOT showing up trackside with a camera.
