Can someone serisouly explain to me, how widening an EXISTING right of way, can cause additional harm to a tortise? Its the same BS that UP ran into in the Columbia Gorge extending the siding at Mosier. It was going to alter fishing treaties? Seriously, how? That's like saying you need an EIS if you ran a red locomotive vs a yellow one. There is no connection. a 25' right of way or a 40' right of way isn't going to change how a @#$%& tortoise is affected. Adding a right of way, sure, but existing? Freaking environmental lawyers are the 2nd lowest scum on earth, right behind personal injury.
