Given Texas' reputation, some lawyer probably will claim it was the train's or rather the railroad's fault. That lawyer will lose, but will cause considerable grief for the train crew in the process.
The pictures show relatively minor damage to the trailer and even the contents (except for the Ferrari). And it didn't get pushed very far. So the train did a good job of shedding speed (or wasn't going fast anyway) before contact.
