Funny that the mill who is protesting may have a federal foot to stand on if the railroad is abandoned, but not if it is rail banked. IIRC there was a case in the med-west where a property owner was granted his land back by the courts due to a clause in the original easement. If forced a re-route of the trail around the property.
Also think of this Patco used to operate an extensive railroad, what if they wanted to purchase the RR for their use and force Smart to connect in Willits?
