The City of Oakland and the environmental justice groups sued to stop a new deep water export terminal and their suit was not successful . There will be a deep water port built , but not sure any coal will move as there are other products that could move via a new terminal when it is built.

One of the reasons the suit failed and Richmonds will also is there is a very negligible amount of coal dust generated by the trains and the unloading operations and because of the suit which lasted 9 years many good working wage jobs on the railroads and the port were lost and before you comment on where the coal is going its not to china in most cases. This is very low sulfur coal with a high BTU compared to Powder River coal . The court followed the science on coal dust not the scare tactics of the NIMBY”S
