The lawsuit holding up the extension, is the RM-3 lawsuit filed against
BATA by the Howard Jarvis Taxpayer's Assoc.

It is now before the CA Supreme Ct. to resolve whether additional tolls
to fund construction far away from bridges constitute a tax, rather than
a fee. If so, approval requires a 2/3 vote which voters was not obtained.

Currently the extra tolls we're paying to cross the state bridges are being
held in escrow pending the outcome of the case. If BATA loses, these will
be refunded as credits through the Fastrak system.

Also at risk is the funding for the relocation of the Bettini Transit Ctr in
downtown San Rafael among other projects.
