States have SOME jurisdiction. Certain states gave railroads like the Southern and MoPac permission to discontinue interstate trains within their states. The CA PUC ordered SP to provide certain levels of service on passenger trains.
This could be a good test case, if necessary, because the states are interested in safety and the public well being---unlike the railroads, who are only interesting in maximizing profits.
