It has to do with the importance of interstate commerce. When a whole buncha the coastline and UP mainline fell into the ocean around Santa Barbara a few years ago the environmentalists immediately set up a howl and Coastal Commission started posturing and everyone said UP couldn't do this and couldn't do that and UP simply said "you are interfering with interstate commmerce and that is a federal offense" and got the tracks repaird and the coast line protected with riprap. This was all done under the very very watchful eyes of the environmentalists but the track DID get repaired. Same thing applies here.
