SMART would want to sue the NCRA for at least a couple of reasons. First it will be very expensive to completly rebuild the railroad, track , bridges , stations, crossings , and keep the track open for freight at the same time . Done with a tight schedule, work windows ect . This alone will probably double the cost of rebuilding the railroad. Second spurs used for freight only will have to be maintained and signaled. Third the bike path issue that SMART strongly endorses conflicts with freight operations . Then operating schedules ,. Will freight be a night time only operation with restricted daylight operations? SMART would love the NCRA to just disslove.
