NWP v. SMART

SMART is hoping to keep freight service from starting up
prior to SMART's fall-2014 projected start-up date.
They have objected to the FRA lifting the EO.
It appears they will try to enjoin the NCRA from
starting up unless the NCRA signs a new Operating
Agreement.
If freight starts up SMART will have to accomodate the
freight trains during the construction phase,
costing SMART $MM it doesn't have.
Meanwhile, NCRA is worried SMART will join the environmental
organizations that have threatened to sue the NCRA
on CEQA grounds.
Stand by ...it'll be an exciting fall/winter.
