While the bridge is owned by the Union Pacific, the top deck is leased by the Oregon DOT/TriMet. My understanding is that the lower rail lift section is operated by a UP employee. However, if the upper deck is to be raised it is done by an ODOT employee. While the lower deck can be raised at any time, anyone needing to raise the upper deck needs to call ODOT at least 24 hours in advance for that to happen.

The upper span is rarely raised so the 24 hour notice is not a big deal. It takes a really big vessel to require the lifting of the upper deck.

Low level talks have been going on for some time between the UP and Tri-Met/ODOT for the two public agencies to take over the ownership of the bridge.
