It's already started. Preliminary suggestions revolved around whether the Engineer failed to act in a safe manner by being negligent in monitoring increased amperage and decreased speed
(See Air Brake and Train Handling Rules), and not taking immediatle action when an unsafe condition existed (unusual slack) (See BNSF Safety Rules for Transportation Employes).

The reading of the tapes will most likely determine how well it can be pinned on the TY&E crew. The Conductor will most likely receive some kind of punitive measure along the same line.

Defective equipment may be the root cause, but immediate, corrective action on the part of the train crew when unusual conditions occour is both required and expected. Period.

They might have good job insurance, though.
