This Is How A Lawyer Thinks

I have a few questions:
(1.) Why wasn't there a squadron of security guards stationed about every ten feet along the right-of-way waving a flag or fusee and shouting to everyone within earshot that a train would soon be coming down the track?
(2.) Why didn't the engine crew apply the emergency brakes when they saw the girl come within an unsafe distance of the train? If Union Pacific can have "track breach" rules for their employees, don't members of the public deserve the same?
(3.) Like a swimming pool is considered an "attractive nuisance" and, by law, is required to have a fence around it, so, too, should a train be considered as such. Where was the fence?
(4.) How soon can all the NIMBYs demand that the BNSF Front Range Subdivision be abandoned and all traffic shifted to the parallel UP line? After all, if we can keep on abandoning more and more of our rail system, incidences such as this will decrease. Operation Lifesaver is always preaching that "trains are dangerous." Why would anyone want something dangerous in their backyard?
