This is happening only because the state is rebuilding the NWP and the state legislators mentioned above therefore think they can force this through; if UP or BNSF were doing the rebuilding, this wouldn't be an issue until the trains started rolling again. The politicians don't have the legal right to force privately owned railroads to pay for quiet zones anyway; the FRA has already made clear that it's up to the communities that want quiet zones to fund and install quiet zone crosssings, NOT the railroads.
