SS is correct on this one, federal law requires the horn to be blown at all PUBLIC crossings unless it's a designated quiet zone, and then the horn can be used in emergency situations. He is correct too about blowing for a crossing already occupied, every experience of mine where that has happened the second train still whistles for the crossing.

I do know the state of Idaho has a law requiring trains to blow the horn at all private crossings as well, but from what I have seen of the class ones and shortlines the run through the state it is a loosely enforced rule, and frankly I don't think many engineers that run though the state know about it.
