The Talgos were not given waivers to run at higher speeds. They were given waivers by the FRA to run. Period. They do not meet US crash standards. As part of their waiver, they are required to be operated with an FRA compliant diesel *or* FRA compliant cab car (read gutted F40) at each end.
Painting is perfectly suitable. Although the problems found were serious enough that it was considered prudent to remove the sets from service, the defects are by no means "fatal flaws" and fully repairable. A fix is currently being engineered, and the sets are estimated by WA-DOT to return to service in January.
