George, I don't think that's correct. The one site notes that the USDOT requires trucks carrying hazardous materials must stop at all railroad crossings. We see them do so all the time at the (1 train a day each way) crossing of Hwy 97 and the CS&CD north of Brewster. I wouldn't think there's a need to codify it on the state level if it's a federal requirement.
