Thanks, Virlon, for mentioning that. Though I quoted the RRB rule which states that in my January 8th post, I failed to mention in the description of my pension that my wife was penalized also under the rule because she continued to substitute teach for the Canby School District until she became disabled.
Non-RRB covered workers probably don't have a clue that actually the working spouse being penalized under the Last Pre-Retirement Nonrailroad Employer rule gets a double whammy because her/his own Tier II is first based on the railroad employee's penalized Tier II and then further penalized for her/his own Last Pre-Retirement Nonrailroad Employer continued employment.
As RRB recipients both the RRB-retired employee and the spouse must individually annually report previous year earnings on RRB Form G-19L and attempt to estimate what the current year earnings will be in each of three categories: (1) Last Pre-Retirement Employer, (2) Net Self-Employment and (3) Other Post Retirement Earnings. Based on those submitted reports the RRB withholds from the monthly pension checks amounts which they deem to satisfy the Tier II penalties. It's very hard to predict when working a part-time on-call job and never comes out even. Last year I had to reimburse the RRB $980 and my wife had to reimburse $162.
