You don't know that the motorcar didn't stop. On the other hand, the trooper interviewed both parties and inspected the site.

The crossing at Hermosa is on a short gravel road cutting through the MoW yard. It is private (D&SNGRR) and protected by STOP SIGNS, but residents cut through there rather than go to the highway access about a quarter of a mile away (inconveniently in the wrong direction when going to Durango).

Looking at the photo, I doubt that minivan did all that damage and traveled that distance from a standing start.
