Good point. As far as publicly owned railroads go, I know the Port of Tillamook Bay allowed the public to hike along their ROW, even when they were still in operation. The top speed was only 10 MPH, and they did warn folks to expect a train at any time and such, but nobody ever got killed or hurt up there, to the best of my knowledge. Since the 2007 storms, I don't think anyone can get up there anymore anyway.
