There is no FRA rule on riders in the cab other than they must have a seat, it is a matter of Co policy and since the Wine Train is promoting it there is no rule violation. I don't find a 3rd person in the cab distracting when I run a locomotive. I don't view it any different than when I have a company official riding in the cab.
