Mare Island Railroad

I'm sure it's been discussed here before, so pardon me for not looking further. If I remember correctly several years ago CN pulled out of Mare Island because FRA was going to force them to spend $$$ to upgrade crossing signals and there wasn't enough traffic to warrant such expense. I was out there a few months ago and saw MIR using a limited ammount of trackage with no crossing signal improvements, whats the deal ?
