This lawsuit will do absolutely nothing to hold NCRA accountable for its failure to live up to its charter mandate; which was to see to it that rail freight service to the North Coast was facilitated - to the ecomonic benefit of all in the region.
If Novato wins, it will in fact, make any chance of success out of reach. Worse yet, the precedent would be set whereby any town can prevent any heavy rail maintenance or renovation from happening. Don't even think it won't happpen; already is. For example, various towns in Arizona are trying to block the double tracking of UP's Sunset Line. And what about the mother of all NIMBYizms - Rochester Minn. and the Mayo Clinic's claim that a few coal trains a day will pose a dire risk to the patients there! They have the ear of the demos in the senate - they will win.
As to Novato, or any NIMBY learning to get along with neighbors or the new kid on the block; that's what's needed in Iraq - between the Sunnis and the Sheeites.
Fat chance there! Slim chance here! There all alike!
